{"id":10836,"date":"2023-11-27T19:23:17","date_gmt":"2023-11-27T19:23:17","guid":{"rendered":"https:\/\/fundinguno.com\/politics\/trump-tells-appeals-court-that-threats-to-judge-and-clerk-in-ny-civil-fraud-trial-do-not-justify-gag-order\/"},"modified":"2023-11-27T19:23:18","modified_gmt":"2023-11-27T19:23:18","slug":"trump-tells-appeals-court-that-threats-to-judge-and-clerk-in-ny-civil-fraud-trial-do-not-justify-gag-order","status":"publish","type":"post","link":"https:\/\/fundinguno.com\/?p=10836","title":{"rendered":"Trump tells appeals court that threats to judge and clerk in NY civil fraud trial do not justify gag order"},"content":{"rendered":"<div data-editable=\"content\" itemprop=\"articleBody\" data-reorderable=\"content\">\n<p class=\"paragraph inline-placeholder\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/clph6whlf00ts26qcdvcecpcg@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n      Donald Trump urged a New York appeals court to continue to pause the gag order against him in his civil fraud trial, saying that threats to the judge and his law clerk do not \u201cjustify\u201d limiting the former president\u2019s constitutional right to defend himself.\n  <\/p>\n<p class=\"paragraph inline-placeholder\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/clph7e2i4000c3b6hkycj87a3@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n      Lawyers for the New York attorney general\u2019s office and the court last week urged the appeals court to put the gag order back in place following \u201cserious and credible\u201d threats that have inundated Judge Arthur Engoron\u2019s chambers since the trial began in October.\n  <\/p>\n<p class=\"paragraph inline-placeholder\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/clph7e2i4000d3b6h77dnv3fd@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n      Trump\u2019s attorneys\u00a0wrote in a filing Monday\u00a0that the former president has never threatened the judge or his principal law clerk and they can\u2019t be held responsible for actions taken by others. They argued that Trump\u2019s First Amendment right to criticize and call out his perception of bias by the judge and his law clerk without retribution is \u201cessential\u201d to maintaining public confidence in the trial.\n  <\/p>\n<p class=\"paragraph inline-placeholder\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/clph7e2i4000e3b6hooxhmk8g@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n      \u201cAt base, the disturbing behavior engaged in by anonymous, third-party actors towards the judge and Principal Law Clerk publicly presiding over an extremely polarizing and high-profile trial merits appropriate security measures,\u201d Trump\u2019s attorneys wrote. \u201cHowever, it does not justify the wholesale abrogation of Petitioners\u2019 First Amendment rights in a proceeding of immense stakes to Petitioners, which has been compromised by the introduction of partisan bias on the bench.\u201d\n  <\/p>\n<p class=\"paragraph inline-placeholder\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/clph7e2i4000f3b6hl2bx7p39@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n      Monday\u2019s filing was the first since hundreds of harassing messages against Engoron and a law clerk were\u00a0made public last week.\u00a0Engoron\u2019s clerk has received 20-30 calls per day to her personal cell phone and 30-50 messages daily on social media platforms and two personal email addresses, according to court papers.\n  <\/p>\n<p class=\"paragraph inline-placeholder\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/clph7e2i4000g3b6hhf6a27hv@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n      Earlier this month a New York appeals court judge temporarily lifted the gag order imposed on Trump and his attorneys that blocked them from making public statements about the judge\u2019s staff, specifically the principal law clerk who he consults with on the bench. Trump and his lawyers have argued that the law clerk is biased against Trump based on political donations she made to some organizations that support the New York attorney general, who sued Trump. They alleged she is \u201cco-judging\u201d the case based on frequent\u00a0consultations she has with the judge. At the time the appeals court judge said he would lift the gag order to allow a fuller panel of judges to weigh in given the constitutional issues at play.\n  <\/p>\n<p class=\"paragraph inline-placeholder\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/clph7e2i4000h3b6hjrntyjc3@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n      Lawyers for the judge submitted filings last week urging the appeals court to put the gag order back in place saying since the gag order was lifted on November 16 the number of messages increased and about half of the harassing messages the clerk received were antisemitic.\n  <\/p>\n<p class=\"paragraph inline-placeholder\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/clph7e2i4000i3b6hgg2m1dmq@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n      Trump\u2019s attorneys said Trump can\u2019t be blamed for others\u2019 comments.\n  <\/p>\n<p class=\"paragraph inline-placeholder\" data-uri=\"cms.cnn.com\/_components\/paragraph\/instances\/clph7e2i4000j3b6h79gzcuk5@published\" data-editable=\"text\" data-component-name=\"paragraph\" data-article-gutter=\"true\">\n      \u201cHowever, none of the contemptible dross reflected in those messages can be attributed to President Trump or his counsel.
